Rapper DMX,real name Earl Simmons, has some good news in regards to the woman with whom he fathered a son outside of his marriage to wife Tashera Simmons(pictured).The woman named Monique Wayne will not be getting $1.5 million dollars in the defamation case that she brought against the rapper in 2006,at least not now: 

So far May has been a rough month for rapper DMX. He was arrested for several driving infractions after a surveillance camera caught the rapper several months ago doing 114 mph in Arizona and the rapper’s home was raided on May 9th which resulted in several drug and animal cruelty charges. But the rapper can find solace in the fact that a $1.5 million default judgment against him has been set aside. The judgment was from a defamation of character lawsuit brought by Monique Wayne, a Baltimore woman who has a child by the rapper. Wayne filed $6 million lawsuit after DMX told Sister 2 Sister magazine, “She raped me. DNA says it is (my child). I don’t know. If I did (have sex with her) I would remember. It ain’t like she’s a pretty girl.”

When the rapper failed to show up for a hearing a default judgment was entered which called for the rapper to pay Wayne $518,400 in compensation and $1 million in punitive penalties.

After the default judgment was entered in January, DMX hired The Murphy Firm, a Baltimore-based law firm and they were able to have the judgment overturned. The rapper’s lawyer Hassan Murphy explained, “Today a very large judgment was vacated by Judge Thomas Smith. The judge clearly agreed with us that Mr. Simmons was never properly notified and therefore he threw out the judgment.”

A new trial date hasn’t been set for the lawsuit.
